These Terms of Service constitute a legally binding agreement made between you and PitchCrierconcerning your access to and use of our website and services.

1. Agreement to Terms

By using our services, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the service.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to use this platform. By registering, you represent and warrant that you meet this requirement. PitchCrier is intended for commercial use and facilitates legally binding arrangements between founders and creators.

3. Intellectual Property Rights

Unless otherwise indicated, the website is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the site are owned or controlled by us.

4. User Representations

By using the site, you represent and warrant that all registration information you submit will be true, accurate, current, and complete.

5. Advertising Disclosure Obligations

PitchCrier facilitates partnerships between businesses ("Founders") and content creators ("Creators"). All content posted in exchange for any form of compensation (including but not limited to discount codes, free products, or affiliate arrangements arranged through our platform) constitutes a paid endorsement under applicable advertising regulations.

Creators are required to clearly and conspicuously disclose the commercial nature of any such content in accordance with the FTC Endorsement Guides (US), ASA CAP Code (UK), and equivalent EU regulations. Accepted disclosures include: "#Ad", "#Sponsored", "Paid partnership", or an equivalent plain-language statement placed prominently in the post.

Founders acknowledge that campaigns created through PitchCrier are subject to these same regulations. Founders must not instruct Creators to omit or obscure material disclosures.

PitchCrier takes reasonable steps to inform Creators of their disclosure obligations at the point of application and in platform communications. However, ultimate responsibility for compliance rests with the individual Creator publishing the content and the Founder who operates the campaign.

6. Billing & Taxes

Subscriptions are billed through LemonSqueezy, our payment processor. Applicable taxes (including VAT) are calculated and collected by LemonSqueezy at checkout based on your location. All prices displayed are exclusive of tax unless stated otherwise.

If you believe a charge is incorrect, please contact us at support@pitchcrier.com before initiating a chargeback or payment dispute. We are happy to resolve billing issues directly and promptly.

7. Account Termination & Data Deletion

You may delete your account at any time from your dashboard settings. Upon deletion, your account data, projects, campaigns, and discount codes will be permanently removed. Billing records may be retained for up to 7 years to comply with tax obligations.

We reserve the right to suspend or terminate accounts that violate these Terms.

8. Limitation of Liability

To the maximum extent permitted by law, PitchCrier shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
